Terms of Service

1. Acceptance of Terms

By accessing or using Sellcast (the "Service") operated at sellcast.co, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Sellcast.

2. Description of Service

Sellcast provides AI-powered product listing analysis, scoring, and optimization suggestions for Etsy and Amazon sellers. The Service includes:

• Free listing scoring with quick-win suggestions
• Full AI listing optimization (title, description, tags, keywords)
• Keyword research tool
• Optimization history and analytics

All AI-generated optimizations are suggestions only. You are solely responsible for the content you publish on any marketplace platform. Sellcast does not guarantee any specific results, rankings, or sales outcomes.

3. Account Registration

To access paid features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.

4. Subscription Plans and Billing

4.1 Plans

Sellcast offers Free, Starter ($19/month), and Pro ($39/month) plans. Each plan has specific usage limits and features as described on our pricing page. Annual billing is available at a 20% discount.

4.2 Payment

Paid subscriptions are billed in advance on a monthly or annual basis via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. All prices are in US Dollars (USD).

4.3 Cancellation

You may cancel your subscription at any time through the billing settings or Stripe Customer Portal. Upon cancellation:

• You retain access to paid features until the end of your current billing period
• No further charges will be made after the current period ends
• Your account will revert to the Free plan
• Your optimization history will be preserved

4.4 Refund Policy

We offer a 7-day money-back guarantee on your first subscription payment. If you are not satisfied within 7 days of your initial purchase, contact us at support@sellcast.co for a full refund. Refunds are not available for:

• Subscription renewals (cancel before renewal date)
• Requests made after the 7-day window
• Accounts that have been terminated for Terms violations

4.5 Price Changes

We reserve the right to change our pricing. Existing subscribers will be notified at least 30 days in advance of any price increase. Price changes will take effect at the start of the next billing period after the notice.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Submit content that infringes on intellectual property rights of others
• Attempt to circumvent usage limits, rate limits, or access controls
• Use automated scripts, bots, or tools to access the Service (except through our official API, if available)
• Share, resell, or redistribute optimized content generated by the Service as a competing product
• Submit harmful, abusive, or offensive content for optimization
• Attempt to reverse-engineer, decompile, or extract our AI prompts, algorithms, or proprietary systems

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

6.1 Your Content

You retain ownership of all listing content you submit to the Service. By using the Service, you grant us a limited license to process your content for the purpose of providing optimizations.

6.2 Optimized Output

AI-generated optimizations are provided for your use. You may use the optimized titles, descriptions, tags, and keywords in your product listings without restriction. However, the optimization algorithms, prompts, and technology remain our intellectual property.

6.3 Our Service

The Sellcast website, brand, design, code, and AI optimization technology are owned by Sellcast and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

7. Limitation of Liability

To the maximum extent permitted by law, Sellcast and its team shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities arising from use of the Service
• Accuracy or quality of AI-generated optimizations or keyword suggestions
• Changes in marketplace algorithms, policies, or rankings that affect your listings
• Service interruptions, downtime, or data loss

Our total liability for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated optimizations will improve your listings' performance
• Keyword data, search volumes, or competition scores are completely accurate
• The Service will meet your specific requirements

9. Indemnification

You agree to indemnify and hold Sellcast harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

10. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for significant changes that affect paid subscribers. Usage limits, features, and supported platforms may change as the Service evolves.

11. Termination

We may terminate or suspend your account immediately if you violate these Terms. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data after a reasonable retention period
• Any outstanding payment obligations remain due

You may also terminate your account at any time by deleting it from your account settings.

12. Governing Law

These Terms are governed by the laws of the European Union and the member state in which Sellcast is established. Any disputes shall be resolved in the competent courts of that jurisdiction. For EU consumers, you retain the right to bring proceedings in your country of residence.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
